These Terms of Use govern your access to and use of Mogi Bro. By creating an account or selecting that you agree, you accept these Terms.
Mogi Bro is a hobby statistics and community platform operated from Australia. It allows Mario Kart players to track mogis, time trials, groups, leaderboards, statistics and community activity. In these Terms, "Mogi Bro", "we", "us" and "our" refer to the operator of the Mogi Bro service.
Mogi Bro is not affiliated with, endorsed by, sponsored by or connected to Nintendo. Mario Kart and related trademarks remain the property of Nintendo and their respective owners.
Mogi Bro is not intended for children under 13, and you must be at least 13 years old to create or use an account. If you are under 18, you should only use Mogi Bro with permission from a parent or guardian.
You are responsible for activity carried out through your account. You must provide accurate account information, keep access to your Google account secure, and promptly contact us if you believe your Mogi Bro account has been used without permission.

Mogi Bro is intended to be a competitive but welcoming community. You are responsible for content you submit and your interactions with other users.

We may investigate suspected breaches and remove or restrict accounts, groups, links, statistics or content where reasonably necessary to enforce these Terms or protect the community and service.
Mogi Bro allows users to create public and private groups. Public groups may be visible to anyone using Mogi Bro. Private groups are intended to be restricted to invited members, but users should not use a group to share highly sensitive information.
Group owners and moderators are responsible for managing their communities fairly and consistently. Mogi Bro may still take action where group activity breaches these Terms or creates a security, legal or community-safety risk.
Creator profiles and groups may link to websites and services operated by other people. Mogi Bro does not control, endorse or accept responsibility for third-party sites, their content or their privacy and security practices. You follow external links at your own discretion. Group owners must not submit links that are illegal, malicious, deceptive or infringe another person's rights.
Mogi Bro provides community statistics, rankings and analytics using information submitted by users. We aim to calculate and display this information accurately, but user submissions, calculations and availability may occasionally be incomplete, delayed or incorrect.
We may remove, correct, adjust or reset statistics where we reasonably believe there has been abuse, manipulation, cheating, duplicate data or a technical error. Where practical, a user may ask us to review an adjustment by contacting admin@mogibro.com.
You retain any ownership rights you have in content you submit to Mogi Bro, including usernames, notes, group names and descriptions, community posts and creator links. You confirm that you have the right to submit that content and that it complies with these Terms.
You grant Mogi Bro a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and process your content only as reasonably necessary to operate, secure, moderate, improve and promote the service, and to make the content available to the audience you selected. Marketing use is limited to content you have made public or content you have separately given us permission to use. We will not use content from a private group in marketing without permission. This licence does not transfer ownership of your content to Mogi Bro.
This licence ends when the content or your account is deleted, except where copies remain temporarily in protected backups, where content has already been shared with or separately created by another user, or where anonymised gameplay data is retained as described in the Privacy Policy. After deletion, we will not make new marketing uses of your deleted content. You may contact admin@mogibro.com to ask us to remove it from existing marketing materials under our control, and we will do so where reasonably practicable.
Our Privacy Policy explains what information Mogi Bro handles, how it is used and what happens when an account is deleted.
Mogi Bro and its authentication provider use essential cookies and similar technologies for sign-in, security and service functionality.
Mogi Bro is currently provided as a free hobby service. We will use reasonable care in operating it, but do not promise that it will always be available, uninterrupted, secure or error-free. Maintenance, technical failures, security incidents and events outside our reasonable control may affect availability.
We may add, change, suspend or discontinue features where reasonably necessary to develop, secure or sustain Mogi Bro. We will provide reasonable notice where a significant planned change materially reduces the service available to users, unless urgent action is required for security, legal or operational reasons.
You may stop using Mogi Bro or delete your account through the Profile page at any time. The Privacy Policy explains what is deleted, anonymised or retained after account deletion.
We may warn, restrict, suspend or terminate an account, group or feature where we reasonably believe these Terms have been breached, the service has been abused, or action is needed to protect users, Mogi Bro or another person. We will generally use a proportionate response and, where practical and appropriate, explain the reason for significant enforcement action. Immediate action may be taken where there is a serious security, safety or legal risk.
You may ask for an enforcement decision to be reviewed by emailing admin@mogibro.com from the address associated with your account. Include your username, the decision you are appealing and any relevant context. We will review the available information and contact you within 15 business days. Repeated appeals without new information may be closed without another full review.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, including any rights that may apply under the Australian Consumer Law.
To the extent permitted by law, Mogi Bro is not responsible for indirect or consequential loss, loss caused by inaccurate or unauthorised user submissions, conduct between users, third-party websites or services, or events outside our reasonable control. You remain responsible for keeping any separate records you need and for checking information before relying on community-entered statistics.
These limitations apply only to the extent they are fair, reasonable and legally enforceable. They do not exclude liability for fraud, wilful misconduct, or any other liability that cannot be excluded under applicable law.
We may update these Terms to reflect changes to Mogi Bro, the law or our safety and security practices. The current version and its effective date will be published on this page.
If a change materially affects user rights or responsibilities, we will provide reasonable notice within Mogi Bro and require you to accept the updated Terms before continuing to use protected account features. If you do not agree, you may stop using Mogi Bro and delete your account. Minor clarifications and changes that do not materially affect users may take effect when published.
If you have a concern about Mogi Bro or these Terms, email admin@mogibro.com with your account email or username, a clear description of the issue and the outcome you are seeking. We will review the matter, contact you within 15 business days and try to resolve it reasonably and in good faith. We may request further information where needed.
These Terms are governed by the laws applicable in Australia and in the Australian state or territory from which Mogi Bro is operated. Subject to any rights you have to bring a claim in another jurisdiction, disputes may be brought before a court with jurisdiction in Australia. Nothing in this section limits a right or remedy available under applicable consumer law.
If part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply. A delay in enforcing a provision is not a waiver of the right to enforce it later. You may not transfer your account or your rights under these Terms to another person without our consent.
